Forests Over Factories: The Case For Green Compensation To Ecologically Rich States In India
(National Law School of India University, 2020) Abhilaksh., Abhilaksh.
The states are dependent on the central government for the approval of forest land diversion projects for the non-forest use. Therefore, the final decision for such projects rests in the hand of the central government. Further, the state incurs the cost for the maintenance of forests because of which forests becomes a hinderance in way of development for the particular state. In this dissertation, the carried work looks into the question: “Why the states need to be compensated for maintaining the forests?” Further the work done in this study looks: “Why the Centre is under duty to pay the compensation?” This dissertation analysed various conventions and case studies which reflects the need for forest conservation. In this work, the study is made to understand the conflict between development and environment. It also studies the repercussions of the actions when the balance between both is not maintained. As per the study carried out in this dissertation, it can be concluded that the centre is under a duty in providing the compensation to the ecologically rich states.
