Safeguarding Minors Online: Evaluating Age Verification Mechanisms in Indian Dating Applications

Abstract
This dissertation explores the effectiveness of age-verification mechanisms on dating
apps in India, with a comparative analysis of international practices and legal
frameworks. The research investigates how these mechanisms serve as barriers to
prevent minors from accessing dating platforms, a critical issue given the legal and
ethical implications associated with the protection of minors in digital environments.
The study employs a comprehensive literature review and an app ethnography
approach, analyzing the signup processes and ongoing age-verification practices of
popular dating apps such as Tinder, Bumble, and OkCupid, among others. Through a
detailed examination of the existing legal provisions—such as the Protection of
Children from Sexual Offences Act (POCSO) 2012, the Information Technology Act
2000, and international statutes like GDPR—the research assesses the compliance of
these platforms with statutory obligations aimed at protecting minors.
Findings from the study reveal significant gaps in compliance, with most apps
relying heavily on self-reported age data, which do not align with the online child safety
provisions of Indian laws. The research highlights the discrepancy between the
protective intent of laws and the practical implementation of age verification on dating
apps, underscoring an underestimation of legal risks and an overarching focus on user
acquisition.
The paper concludes with recommendations for enhancing age verification
processes, suggesting the integration of advanced technologies such as biometric
verification and artificial intelligence. It argues for a harmonized approach to legal
definitions and age verification standards that not only align with international best
practices but also bolster the safety and integrity of online dating environments,
ultimately protecting minors more effectively.
This study aims to contribute to the broader discourse on digital safety and
regulatory compliance, offering insights that could guide policymakers, app developers,
and stakeholders in strengthening the frameworks that govern the operation of dating
apps, particularly in contexts where the safety of minors is at stake.
