dc.description.abstractA few decades ago, access to credit was limited to a select few, constrained by traditional banking infrastructures and stringent eligibility criteria. However, the proliferation of technological innovations by fintech companies has significantly increased access to credit, transforming financial practices and enhancing economic well-being for many individuals. However, regulations have not kept pace with these advancements, leading to varied experiences and levels of trust among users. This study aims to critically assess how well fintech companies comply with the Reserve Bank of India's Digital Lending Guidelines with an emphasis on customer protection. The study specifically focuses on personal loans, as these constitute the majority of loans disbursed by fintech companies, ensuring a representative analysis of their lending practices. Employing a mixed-methods approach, the research integrates qualitative analysis to understand the compliance of fintech companies' privacy policies with the guidelines and quantitative surveys to understand consumer grievances, compliance levels, and their satisfaction and awareness of the guidelines. The analysis revealed significant disparities in the compliance of privacy policies among digital lending fintechs and numerous reported grievances including misuse of personal data, harassment by the recovery agents, technical issues in timely payments and inaccurate reporting to the Credit Bureaus that remain unresolved, undermining consumer trust and highlighting gaps in the current regulatory framework. These findings underscore the need for more rigorous enforcement of regulatory standards to bridge these gaps and ensure robust consumer protection in the digital lending space. Finally, some policy recommendations have been outlined by the researcher balancing customer protection and the resource constraints faced by the fintech companies as they navigate the regulatory environment.en_US
